Justice Mohamed Warsame sworn in as Supreme Court judge, strengthening Kenya’s apex court following the vacancy left by the late Justice Mohamed Ibrahim.
Justice Mohamed Warsame has officially been sworn in as a Judge of the Supreme Court of Kenya in a ceremony held at State House, Nairobi, presided over by President William Ruto and attended by Chief Justice Martha Koome. His appointment marks a significant moment for the Judiciary as Kenya moves to strengthen the apex court following a vacancy left by the late Justice Mohamed Ibrahim, who passed away in December 2025.
Justice Warsame becomes the 14th judge of the Supreme Court, joining the country’s highest judicial bench at a time when the court continues to handle some of the most sensitive constitutional, electoral, and public interest cases in the nation.
The swearing-in ceremony was held in line with constitutional requirements, where newly appointed judges of superior courts are formally inducted into office by the President after nomination and approval by the Judicial Service Commission (JSC) and subsequent vetting by Parliament. His appointment followed the Judiciary’s official recruitment process aimed at filling the gap created by the passing of Justice Ibrahim, ensuring the Supreme Court remains fully constituted to carry out its mandate effectively.
Justice Warsame is not new to Kenya’s legal landscape. He brings with him decades of judicial experience, having previously served in various capacities within the Kenyan judiciary, including at the High Court and Court of Appeal levels. Known for his firm approach to constitutional interpretation and his experience in handling complex legal disputes, his elevation to the Supreme Court is widely seen as a reinforcement of institutional experience at the apex court.
The Supreme Court of Kenya, established under Article 163 of the Constitution of Kenya 2010, is the highest court in the land. It has final appellate jurisdiction in constitutional and presidential election disputes and plays a crucial role in shaping legal precedent in the country. Over the years, the court has been central in landmark rulings, including presidential election petitions, devolution disputes, and cases involving fundamental rights and freedoms.
President William Ruto, while presiding over the ceremony, emphasized the importance of an independent and strong judiciary in upholding constitutional democracy. He noted that the judiciary remains a key pillar of governance and that the appointment of experienced judges like Justice Warsame strengthens public confidence in the justice system.

Chief Justice Martha Koome also welcomed Justice Warsame to the Supreme Court, highlighting the importance of teamwork among the apex court judges in delivering timely and well-reasoned judgments. She reiterated the Judiciary’s commitment to justice, transparency, and efficiency, especially as the court continues to face a growing caseload involving constitutional interpretation and national interest matters.
Justice Warsame’s appointment comes at a critical time when the Supreme Court is expected to handle several high-profile matters, including electoral disputes, constitutional petitions, and cases with significant socio-political implications. The court’s role has increasingly become central in shaping Kenya’s democratic trajectory, particularly after the 2010 Constitution expanded its mandate.
The vacancy he fills was created following the death of Justice Mohamed Ibrahim in December 2025, a judge remembered for his contributions to Kenya’s jurisprudence and constitutional law. His passing left a gap in the Supreme Court that the Judiciary sought to fill swiftly to ensure continuity in its operations and maintain the required quorum for hearing and determining cases.
The Judiciary Service Commission, which is responsible for recommending judicial appointments, had earlier forwarded Justice Warsame’s name after a competitive selection process. His nomination was subsequently approved, paving the way for his formal swearing-in at State House.
Legal experts have noted that Justice Warsame’s presence on the bench is likely to bring valuable experience, particularly in appellate jurisprudence and constitutional interpretation. His long service in the judiciary is expected to contribute to strengthening legal reasoning and consistency in Supreme Court rulings.
Kenya’s Supreme Court has grown in prominence over the years, especially after handling historic presidential election petitions in 2013, 2017, and 2022. These cases have not only shaped Kenya’s political history but also reinforced the court’s position as a key arbiter of electoral justice in Africa. The addition of a new judge is therefore significant in ensuring the court continues to function efficiently, especially given the complexity and volume of cases it handles.
With Justice Warsame now officially part of the Supreme Court bench, attention will shift to how the court continues to handle its constitutional responsibilities and maintain public trust. His experience and judicial background are expected to contribute to the court’s stability as it navigates an evolving legal and political landscape in Kenya.
The swearing-in ceremony at State House symbolized not only a constitutional milestone but also a reaffirmation of Kenya’s commitment to the rule of law and judicial independence.
